Paramjeet Kaur is facing testing times nearly two decades after she passed her Class XII examination. Her result, declared in 2001, has been cancelled and that too allegedly without the issuance of a show-case notice.
Aggrieved by the “illegal cancellation” of the result, the art and crafts teacher has now moved the Punjab and Haryana High Court against the action. Taking up her petition filed through counsels RS Bajaj and Sidakjit S Bajaj, Justice Sudhir Mittal of the HC has ordered that criminal proceedings would not be initiated against her.
Justice Mittal also made it clear that the orders placing her services under suspension or initiating disciplinary proceedings, if any, would also remain stayed. The order would be in operation at least till March 3 when the case would come up for resumed hearing.
The direction came after RS Bajaj, among other things, told the Bench that the petitioner’s Class XII result was illegally cancelled without the issuance of a show-cause notice. He contended that the petitioner passed her Class XII examination in 2001 and a certificate was also issued.
In 2016, she obtained employment as an art and crafts teacher. As such, her educational certificates were sent for verification. At the time of verification, respondent — Punjab School Education Board (PSEB) — raised a dispute regarding the genuineness of her certificate.
Giving reasons, it said the remark of ‘RL fees’ was written against her name in the relevant gazette notification. Bajaj contended the remark meant the result was to be declared later as fee had not been deposited. “In view of the issuance of certificate, the remark was meaningless. Still the petitioner paid the late fee, yet the result has been cancelled without conducting an inquiry,” Bajaj added.
