Ensure arrest of murder accused, court tells Hoshiarpur SSP

In a major embarrassment to the Punjab Police, the Punjab and Haryana HC has directed Hoshiarpur SSP to ensure adoption of “all necessary steps” for arresting two accused in a murder case. The officer has also been directed to ensure the filing of supplementary report at the earliest with regard to the accused.

The direction by Justice Gurvinder Singh Gill is significant as complainant-petitioner Akash Rana in his petition had alleged that accused Darshan Lal and Mahinder Pal were brothers of Phagwara DSP Surinder Chand. The complainant had further alleged that the police were all out to extend favours to the two. The police did not arrest them though they were specifically named in the FIR and there were specific allegations against the two.

The complainant had added the accused, taking advantage of their non-arrest, submitted a representation for inquiry to the Jalandhar Range Inspector General of Police. It was marked to SP (Narcotics) in Kapurthala district, where their brother was also posted.

Rana had moved the court for transferring the investigation back to Hoshiarpur district in the FIR registered on December 12, 2019, at the Garhshankar police station for murder and other offences. Directions were also sought to constitute a SIT.

Justice Gill asserted that a perusal of the FIR showed that the complainant had named eight accused, including Darshan Lal and Mahinder Pal.
