HC stays withdrawal of time scale to ex-registrars

Two months after the Punjab and Haryana HC ordered the withdrawal of time scale to two of its former registrars, a Bench has stayed the order.

The stay came on two petitions filed by Gopal Krishan Khanna and another petitioner against the HC. Another petition in the matter has also been filed by former registrar Ashok Kumar Arora. Khanna had contended that the time scale granted to the petitioner, as admissible to the members of the Superior Judicial Service, from October 23, 2008, had been withdrawn. It was submitted that a notice was not issued to the petitioner before the order was passed. As such, the principles of natural justice had been violated. “It is contended that as per the registrar, HC of Punjab amp; Haryana (Appointment amp; Conditions of Service) Rules, if the Registrar is not a member of service, he is entitled to same pay as admissible to the member of Punjab/ Haryana Superior Judicial Services and the benefit had rightly been granted,” Justice GS Sandhawalia said. — TNS
