Punjab and Haryana High Court dismisses cops’ plea in ’97 kidnap case

The Punjab and Haryana High Court has dismissed a bunch of petitions filed by Punjab police officials seeking the setting aside of order passed in October 2016 by the Patiala CBI Special Judge, vide which their applications for dropping CBI proceedings in a kidnapping case was dismissed. Their plea was that the CBI was not having territorial jurisdiction to register the case and conduct the trial.

Justice Arvind Singh Sangwan observed the CBI registered the case on February 28, 1997, for kidnap and common intention under Sections 364 and 34 of the IPC in Jamp;K regarding the abduction and killing of Sukhwinder Singh in Amritsar. Similarly, other connected cases, were also registered regarding abduction and killing of innocent persons.

The petitioner’s counsel argued the CBI had registered the “RC” in Jamp;K as special investigating unit-XVI at Jammu was assigned the investigation of all cases. But the unit had no jurisdiction either to register an FIR or conduct an investigation. Justice Sangwan asserted the court found that the trial court had rightly decided the issue of jurisdiction, which vested with SIU-XVI Branch, Jammu, to conduct the investigation. — TNS
