A major political and national security controversy has erupted over the Matthew Aaron VanDyke case after the National Investigation Agency filed a chargesheet without invoking the Unlawful Activities (Prevention) Act, or UAPA, against the American citizen and six Ukrainian nationals.VanDyke and the six Ukrainians were arrested in March 2026 in a case involving allegations that they entered India without the required permissions, travelled toward Myanmar and provided drone-warfare training to ethnic armed groups. The NIA had initially registered the case under Section 18 of the UAPA, relating to conspiracy to commit terrorist acts.However, the latest chargesheet filed before a Delhi court cites provisions of the Immigration and Foreigners Act instead. The development has triggered a political storm, with Congress leaders alleging that the Narendra Modi government may have come under pressure from the United States. Jairam Ramesh has questioned whether the UAPA provision was removed after a proper investigation or because of alleged American pressure.The NIA, however, says the terror investigation has not been closed.
